2. Scope of Services
Vajra Cyber-Fortress provides elite cybersecurity solutions, including but not limited to penetration testing, data encryption, cloud security audits, and threat intelligence. The specific scope of work for any engagement will be defined in a separate Master Services Agreement (MSA) or Statement of Work (SOW) signed by both parties. These Terms & Conditions serve as the foundational legal framework for all such engagements.
We reserve the right to modify, suspend, or discontinue any aspect of our Services at any time, with or without notice, to maintain the security and operational integrity of our infrastructure or to comply with evolving legal requirements.
3. Professional Integrity & Ethical Conduct
Vajra Cyber-Fortress operates under a strict code of ethical conduct. Our services are intended solely for legitimate security enhancement and defensive purposes. Clients represent and warrant that they have the legal authority to authorize security testing and audits on the systems and data they provide to us. Any attempt to utilize our Services for malicious, unauthorized, or illegal activities will result in immediate termination of the engagement and reporting to the relevant authorities.
Clients agree not to attempt to reverse-engineer, decompile, or otherwise extract the proprietary methodologies or software code utilized by Vajra in the provision of its Services. All technical tools and intellectual property developed by Vajra remain the exclusive property of Vajra Cyber-Fortress.
4. Client Responsibilities
The effectiveness of our 'Cyber-Fortress' model depends on active collaboration and accurate information from the Client. Clients agree to provide all necessary access, documentation, and technical support required for the successful execution of our Services. Furthermore, Clients are responsible for maintaining the confidentiality of any credentials or secure communications provided by Vajra during an engagement.
Clients must ensure that their use of our Services does not violate any third-party agreements or intellectual property rights. Vajra is not responsible for any service disruptions or data loss resulting from the Client's failure to provide accurate information or necessary authorizations.
5. Limitation of Liability
While Vajra Cyber-Fortress utilizes the highest standards of technical precision and professional care, the nature of cybersecurity is inherently dynamic. No security system is absolutely impenetrable. Vajra does not guarantee that our Services will identify every possible vulnerability or prevent all potential cyber attacks. Our liability is limited to the professional execution of the agreed-upon scope of work.
In no event shall Vajra Cyber-Fortress be liable for any indirect, incidental, special, or consequential damages, including but not limited to loss of profits, data, or business reputation, arising out of or in connection with the use of our Services, even if we have been advised of the possibility of such damages. Our total liability under any engagement shall not exceed the fees paid by the Client for the specific Service in question.
6. Intellectual Property Rights
All content on our Site, including text, graphics, logos, and images, is the property of Vajra Cyber-Fortress and is protected by Indian and international copyright and trademark laws. Unauthorized use of our brand assets is strictly prohibited. Any reports, dashboards, or deliverables provided to the Client as part of an engagement are for the Client's internal use only and may not be shared with third parties without our express written consent.
7. Governing Law & Jurisdiction
These Terms & Conditions shall be governed by and construed in accordance with the laws of the Republic of India. Any disputes arising out of or in connection with these terms shall be subject to the exclusive jurisdiction of the courts in Bangalore, Karnataka. Both parties agree to attempt to resolve any disputes through professional mediation before seeking judicial intervention.
8. Confidentiality Protocol
Confidentiality is the cornerstone of our professional relationship. Both Vajra and the Client agree to treat all non-public information exchanged during an engagement as strictly confidential. This obligation extends beyond the termination of the engagement and covers all technical, financial, and strategic information. We implement rigorous internal controls to ensure that Client data is handled with the highest level of security and discretion.
9. Termination of Engagement
Either party may terminate an engagement for cause if the other party breaches any material provision of these Terms & Conditions and fails to cure such breach within thirty (30) days of written notice. Upon termination, the Client shall pay for all Services rendered up to the date of termination, and both parties shall return or destroy any confidential information belonging to the other party.
